1. Scope
These General Terms and Conditions apply to enquiries regarding antenatal and postnatal care, as well as to bookings for and participation in antenatal classes provided by midwife Esther Siebmann.
The specific course terms apply exclusively to the antenatal course booked. Booking a course does not constitute an agreement for antenatal or postnatal care.
2. Registration for Antenatal and Postnatal Care
Registration through Hebamio constitutes a non-binding enquiry for care. After checking availability, the midwife will notify the applicant by email whether care can be provided. An automated acknowledgement of receipt does not constitute confirmation of care.
A separate treatment agreement, signed by both parties, will be concluded for antenatal and postnatal care. This agreement governs, in particular, the scope of services, availability, appointment arrangements, billing and cover by another midwife.
3. Registration for an Antenatal Course
Registration through Hebamio constitutes a non-binding enquiry for a course place.
After availability has been checked, the pregnant participant will receive a separate course treatment agreement. This will be sent electronically and may be signed and submitted digitally. Alternatively, the agreement may be printed, signed by hand and returned as a scanned copy or by post.
The course place is booked on a binding basis once the course treatment agreement has been signed by both the pregnant participant and the midwife. A prior acknowledgement of receipt or notification that a place is available does not constitute a binding booking. Once both parties have signed, the pregnant participant will receive an electronic copy of the agreement.
If the requested course is fully booked, the pregnant participant may join the waiting list without obligation.
4. Course Structure and Venue
The antenatal course consists of seven evening sessions, each lasting 120 minutes. An accompanying person may attend sessions 3, 4 and 5.
The pregnant participant may attend the entire course without an accompanying person. Her booking and participation are independent of any registration or payment by an accompanying person.
The course takes place in person. Unless otherwise stated in the relevant course description, the venue is:

5. Online Participation in the Event of Illness
If the pregnant participant is ill, online access to the in-person course may exceptionally be arranged by prior agreement. For sessions open to accompanying persons, the registered accompanying person may also participate online.
This is subject to technical and organisational feasibility and the prior consent of everyone attending the relevant session. Separate consent forms signed by all participants, including accompanying persons, must be received before the video transmission begins.
There is no entitlement to online access. If any required consent is missing or is withdrawn before the transmission, online access will not be provided. If consent is withdrawn during the transmission, the transmission will be ended.
Audio recordings, photographs, video recordings and screenshots of the course are not permitted. Online participants must ensure that people who are not participating cannot watch or listen to the course.
The separate information and consent forms concerning video transmission also apply.
6. Fees and Billing for Pregnant Participants
Participants with statutory health insurance
Course hours actually attended and eligible for reimbursement under the applicable German Midwifery Services Agreement (Hebammenhilfevertrag) will be billed directly to the health insurance fund.
Missed course hours will not be charged privately to participants with statutory health insurance.
Online participation will be billed to the health insurance fund only where the applicable requirements are met.
Any change of health insurance fund must be communicated to the midwife promptly.
Privately insured and self-paying participants
Course services actually attended will be billed at twice the standard rate under the applicable Schleswig-Holstein fee regulations for midwifery services provided to self-paying patients, insofar as this rate is permitted for the service concerned.
Before the course begins, the participant will receive information in text form, such as by email, stating the price per course hour and the estimated total cost for full attendance.
A private invoice will be issued. The payment deadline will be stated on the invoice.
Whether and to what extent private health insurance reimburses the costs depends on the individual insurance policy. The participant remains responsible for paying the agreed fee regardless of any reimbursement.
7. Participation and Fees for Accompanying Persons
Participation by an accompanying person is voluntary. The pregnant participant may attend the entire course without an accompanying person. Her registration and participation are independent of any registration or payment by an accompanying person.
The accompanying person’s registration may be submitted by the pregnant participant. The accompanying person will receive a separate agreement covering the paid participation, including the fee provisions, which the accompanying person must personally sign. The documents may be sent to the pregnant participant together with the course treatment agreement and returned through her. The accompanying person’s booking becomes binding once the midwife has received the agreement signed by both contracting parties.
The accompanying person is personally responsible for payment.
A flat fee of €75 applies to the three designated sessions open to accompanying persons. Individual sessions cannot be booked separately. Partial attendance or absence from individual sessions does not, in itself, result in a fee reduction. This also applies to permitted online participation. Statutory rights to a reduction or refund and statutory termination rights remain unaffected.
The fee must be paid in advance by bank transfer. Payment is due within 14 days once the booking is binding and the payment information has been received. Bank details will be provided.
If the midwife cancels a session open to accompanying persons without providing a replacement, €25 per cancelled session will be refunded within 30 days after the course ends. If the midwife cancels the entire course, advance payments already received will be refunded without undue delay.
Following attendance, the accompanying person will receive confirmation of attendance and payment for possible submission to their health insurance fund. Whether and to what extent the fees are reimbursed depends on the fund’s benefit conditions.
8. Withdrawal and Missed Sessions
The pregnant participant may withdraw from the course free of charge by email. Services already attended will be billed in accordance with Section 6.
Withdrawal by an accompanying person and non-attendance at individual sessions are subject to the fee provisions in Section 7. Withdrawal by the pregnant participant does not automatically terminate the separate agreement with the accompanying person. Statutory termination rights and statutory rights to a fee reduction or refund remain unaffected.
Participants and accompanying persons are requested to give as much notice as possible of withdrawal from the entire course or inability to attend individual sessions.
There is no entitlement to an individual catch-up session or a place on another course for missed sessions.
9. Minimum Number of Participants and Cancellation of the Entire Course
A minimum of six pregnant participants with binding bookings is required for a course to take place. Accompanying persons do not count towards this minimum.
If fewer than six pregnant participants have binding bookings, the midwife may cancel the course no later than three weeks before its scheduled start date. Notification will be sent by email.
Fees already paid for the cancelled course will be refunded without undue delay.
An alternative course will only be booked with the participant’s agreement. Statutory rights remain unaffected.
10. Cancellation of Individual Sessions
If a session cannot take place for an important reason, particularly illness of the midwife or an unforeseen professional emergency, participants will be informed as early as possible.
A replacement session will be offered where organisationally and practically feasible. No unconditional guarantee is given that cancelled sessions will be rescheduled. If no replacement can be arranged, the affected session will be cancelled without replacement.
Sessions that are cancelled and not subsequently provided will not be billed to the health insurance fund, the participant or the accompanying person.
If an accompanying person cannot attend a replacement session offered by the midwife, the flat fee will be reduced by €25 for each affected session. Amounts already paid will be refunded within 30 days after the course ends. The pregnant participant will incur no additional costs for being unable to attend the replacement session.
The statutory rights of the contracting parties remain unaffected.
11. Liability
The statutory provisions on liability apply.
12. Data Protection
Personal data required for registration, care, course delivery, documentation and billing will be processed using the Hebamio practice management software. Data necessary for billing will be transmitted to the relevant health insurance fund.

Acceptance of these General Terms and Conditions does not replace any separate consent that may be required under data protection law.
